About the SQE2 – the practical legal skills assessment

SQE2 tests six skills:

The skills are assessed in the context of the following legal practice areas:

  • Criminal Litigation
  • Dispute Resolution
  • Property Practice
  • Wills and Intestacy, Probate Administration and Practice
  • Business Law

The skills are assessed through 16 simulated legal environments known as ‘stations’, which sample across the skills and practice areas. Candidates cannot choose the practice area for their skills assessment. The SQE2 exams are offered across five days.

What are you expected to demonstrate?

The SRA has set a Statement of Solicitor Competence, which defines the level of competence expected of all solicitors admitted to the Roll. This statement uses a broad definition of competence, being the ability to perform the roles and tasks required by one’s job to the expected standard.

This definition recognises that requirements and expectations change depending on job role and context. It also recognises that competence develops over time and experience, and that an individual may work ‘competently’ at many different levels, either at different stages of their career, or indeed from one day to the next depending on the nature of their work.

In short, you should know and understand the relevant legal principles and basic law and be able to draw on and apply these to the client’s situation at hand in order to provide accurate and timely advice. You should also be able to identify which documents to use and be able to draft documents yourself when needed.

Assessing your practical legal skills

Use of stations to assess your performance: the six skills are assessed through simulated legal environments also known as ‘stations’. The techniques to create these stations include the use of actors as interviewed clients and writing legal advice to the client.

Simulation of a solicitor-client interaction: using ‘standardised clients’ – trained actors who play the role of a client with whom you interact during a station, the SQE exams assess your ‘soft skills’ as much as your formidable legal knowledge.

So during an interview assessment, for example, an actor playing a client may ask you to advise them on transferring their interest in their property to a third party.

In another station you may be asked to interview the client, then, following their instructions, prepare their will, or complete or interpret IHT forms, or apply for probate.

Or you may be advising a client about how to structure their new business and how they can minimise tax liability. The syllabus is vast and the possible scenarios are many!

Preparation for a practical assessment requires a practical approach

A higher level of legal knowledge and understanding is required: while the SQE1 exam assesses your knowledge and understanding of academic and procedural law, the SQE2 exam demands considerably more from you: your ability to accurately advise clients using a variety of skills, including drawing on and applying the law to a very specific set of circumstances.

Medical assessment methodologies: as a future doctor cannot rely only on reading a book in advance of a practical assessment that involves taking a blood sample, so a potential English solicitor cannot rely only on reading about practical legal skills in advance of a practical assessment that tests their skills as a lawyer advising the public.

The course guide covers the structure, methodology, and marking criteria of the practical assessment, study guides, and test administration procedures, protocols, and policies – everything you need to know about what is expected of you and how you will be assessed.

SQE2 Practice Questions

The practice questions include multiple exercises that are based on a single scenario/case study common to that practice area.

The questions come with a variety of documents and forms which you may see in the formal SQE2 exam, such as a letter of claim and particulars of claim; board and members’ resolutions; defence and witness statements; a bail application; wills, IHT forms, oaths, and probate applications; purchase deeds, a copy of the register and site plan, and purchase and sale contracts.

Each question includes a proposed solution to help you assess your level of knowledge and understanding of the skills and practice areas which will be assessed on the SQE2 exams.

Practice Area Summaries

These notes (about 200 pages in total) discuss the essential elements of the law and practice areas, are summarised and divided into sections, and cover the main topics tested in the SQE2 exams. The summaries are excellent for revision purposes and save you the time and hard work in preparing your own notes.

These summaries offer all the information needed to enable you to work through the various practice areas with ease and refer back to them during the final mock and the SQE assessment preparation.

The summaries cover Property Law, Wills and the Administration of Estates, Dispute Resolution, Criminal Litigation, and Business Law. You will receive free periodic updates for the summaries when the law changes.

300 Mock Exams with Model Answers for Self-Assessment

The 300 mock exams cover all the legal practice areas and the skills tested on the SQE2 assessments (check the matrix to see the topics/skills covered by each of the tasks).

The mock exams provide you with an ample opportunity to deepen your legal knowledge and hone your practical skills. Points to note or proposed submissions for each mock exam enable you to understand what is required of you and thus, identify areas requiring development during your preparation.

The videos on the client interviewing and advocacy skills include good and bad role-play scenarios so that you can understand what is required to pass and what will lead to failure. All of these useful videos are accompanied by pre and post-commentary notes delivered by an experienced legal skills trainer.

Legal writing: develop your skills and learn from an experienced tutor with extensive experience in the legal practice, who will walk you through the most important things to focus on when you write a letter of advice or an email to your client, an internal memo or an attendance note. This series of videos also cover the basic principles of English legal writing, such as using plain English free of jargon or ‘legalese’, punctuation, grammar, numbers, citations, and more. Legal drafting: receive guidance on drafting commonly used documents in various contexts you may be faced with during the SQE2 exam, including commercial contracts, shareholders’ and partnership agreements, limited company and LLP incorporation, board minutes, statements of case, a claim form, particulars of claim, draft orders, purchase deed, property transfer forms, first registration, defence and witness statements, a hearsay form, a will, IHT forms, oaths, and many more. The presentations will also address the right way to use precedent documents and completing forms. Case and matter analysis: learn about the steps you need to take in your work, such as identifying the relevant facts and using preliminary tools of analysis, carrying out legal analysis, considering strategies for negotiation, assessing risks and client’s needs, advising on the next steps, and reporting to the supervising partner.

Mock Practice Stations with Personal Tutor Feedback

You will have the opportunity to practise online one-to-one mock stations in client interviewing and advocacy, with an experienced tutor/actor, who will provide feedback based on Kaplan and the SRA Marking and Moderation Policy.

For example, after attending the live interviewing mock station, under the section “Client-focused”, your tutor may mark your mock as “C”, which means: “Marginal pass: on balance, just meets the competency requirements of the assessment”. In addition, the tutor will provide you with a detailed explanation and feedback for the reasons of your grading (law and skills are weighted equally).

The mock practice stations are designed to successfully prepare you for the SQE2 practical assessment and are regarded by many of our former QLTS candidates as the most effective way to genuinely assess your level of knowledge, professional skills and understanding of legal practice to a level that meets the SRA assessment requirements.

15 English Writing Tasks

In the SQE2 exams, you will be required to complete several tasks such as writing a memo or written advice to the client or the supervising solicitor or to prepare an attendance note after the interview assessment.

You will be expected to be able to use appropriate, clear, precise and acceptable English. The English writing tasks will help you improve your English writing skills and demonstrate that you meet the SRA requirements.

The writing tasks could be on administrative or procedural matters in which you produce an email or a formal letter for a client or a third party. Each task includes an assignment, specimen letter, and commentary to help you assess your performance. You should complete the writing tasks before attempting the SQE2 mock exams for self-assessment.

Do you need to arrive at any physical location to take the SQE2 preparation course?

No – you can study anytime, anywhere: you can study for the assessment from any location in the world, without attending classroom lessons at a physical location.

The course content (e.g., mock exams and suggested answers, flash cards and videos) will be available through SQE Learning, our online training system, so that you can assess your own development and progress.

The online mock practice stations with personal tutor feedback will be conducted over Skype or GoToMeeting at mutually agreed times. You must have web camera and microphone for the interviewing and advocacy/oral mock stations.

You will have the initial consultation with your tutor after we receive your completed questionnaire. Please allow your tutor 2-3 working days to review your questionnaire and prepare for your initial consultation call. Access to the SQE Online Training System will be activated shortly after you sign up for the course and will remain valid for two consecutive sittings of the practical legal skills assessment or until you have passed all the SQE2 exams, whichever happens first.
